Clarifier: New Sunday penalty rates

There has been some confusion in the convenience store industry caused by the recently announced reduction in Sunday penalty rates, applicable to four awards announced last week by Fair Work Australia.

Most employees in the P&C sector are covered by the Vehicle Manufacturing, Repair, Service and Retail Award 2010. Under this award, Sunday rates are set at time and a half.

Some organisations operate under other awards, while others operate under EnterpriseAgreements.  The announced reductions in penalty rates do not affect any other awards or agreements.

Here are the new rates handed down by the Fair Work Commission:

 

Hospitality Award

Full time and part time employees – Down from 175% to 150%

(no change for casuals)

 

Fast Food Award (Level 1 employees only)

Full time and part time employees – Down from 150% to 125%

Casual employees – Down from 175% to 150%

 

Retail Award

Full time and part time employees – Down from 200% to 150%

Casual employees – Down from 200% to 175%

 

Pharmacy Award (7.00 am to 9.00 pm only)

Full time and part time employees – Down from 200% to 150%

Casual employees – Down from 200% to 175%
