Illicit tobacco and vape crackdown sees Mackay stores closed

Five stores in Mackay have been shut and eight had products seized after raids targeting the sale of illegal tobacco and vapes.

The Mackay Public Health Unit (MPHU), part of Mackay Hospital and Health Service (HHS), led the operation over the past three weeks. The raids were the first in the region since Queensland’s new smoking product laws came into effect in September 2024.

Brigid Fenech, HHS Director of Public Health, said this sends a clear message that illegal tobacco sales will not be tolerated in the community.

“Our public health officers will continue to be vigilant to ensure retailers of tobacco, vapes and other smoking products comply with the law.”

With support from Queensland Police, authorities used new entry and search powers to inspect stores across the city. Contraband seized included nicotine vapes, ‘chop chop’ tobacco, illegal cigarettes, vape liquid refills, ice pipes and bongs.

Stores found in breach of the law were issued with on-the-spot fines and ordered to shut for 72 hours. Repeat offenders can now be forced to close temporarily without prior court action.

Penalties have also increased under the new legislation. Retailers may face up to two years in prison, while employees caught working in a non-compliant store during a closure could be fined up to $32,260.

Charges are being pursued under both the Tobacco and Other Smoking Products Act and the Medicines and Poisons Act.
